Terms of Service Agreement for ficktok Users

By accessing, browsing, or using the website located at ficktok.co (the "Site") or the associated mobile application (the "App"), collectively referred to as the "Platform," you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a binding agreement between you ("User," "you," or "your") and ficktok ("we," "us," or "our").

If you do not agree to all of these Terms, you must not access or use the Platform. Your continued use of the Platform following the posting of any changes to these Terms constitutes your acceptance of those changes. We reserve the right to modify these Terms at any time, effective upon posting the updated Terms on the Platform.

ficktok provides an online platform designed for adults to connect, communicate, and potentially arrange social or romantic encounters. Our services ("Services") include, but are not limited to:

• User profile creation and management.
• Search, discovery, and matching functionalities with other users.
• Private and group messaging tools.
• Platform features that facilitate user interaction and connection.
• Any other features, content, or applications offered from time to time by ficktok.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, including the availability of any feature, database, or content, without prior notice or liability.

You are solely responsible for your conduct, your interactions with other users, and any content you post, transmit, or share on the Platform. You agree to use the Services only for lawful purposes and in accordance with these Terms.

Prohibited Activities Include, but are not limited to:

1. Using the Platform if you are under 18 years of age.
2. Harassing, bullying, threatening, or intimidating any other user.
3. Posting content that is illegal, obscene, defamatory, threatening, or infringes on any third party's intellectual property or privacy rights.
4. Impersonating any person or entity or falsely stating your affiliation with a person or entity.
5. Engaging in any form of spamming, phishing, or distributing malware.
6. Attempting to gain unauthorized access to the Platform, other user accounts, or related systems.
7. Using the Platform for any commercial solicitation or advertising without our express written consent.
8. Violating any applicable local, state, national, or international law or regulation.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by ficktok, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The "ficktok" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ficktok or its affiliates or licensors. You must not use such marks without the prior written permission of ficktok.

You retain ownership of any content you submit, post, or display on or through the Platform ("User Content"). By posting User Content, you grant ficktok a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Platform and ficktok's business.

To the fullest extent permitted by applicable law, in no event shall ficktok, its affiliates, directors, employees, licensors, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform.
• Any conduct or content of any third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other users.
• Any content obtained from the Platform.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total cumulative liability to you for all claims arising from or related to the Platform or these Terms shall not exceed the amount you have paid to ficktok, if any, in the twelve (12) months preceding the event giving rise to the liability, or one hundred US dollars ($100.00), whichever is greater.

YOUR USE OF THE PLATFORM AND SERVICES IS AT YOUR SOLE RISK. THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ficktok EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ficktok makes no warranty that (i) the Platform will meet your requirements, (ii) the Platform will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Platform will be accurate or reliable, or (iv) the quality of any products, services, information, or other material obtained by you through the Platform will meet your expectations.

No advice or information, whether oral or written, obtained by you from ficktok or through the Platform shall create any warranty not expressly stated in these Terms.

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

Upon termination, your right to use the Platform will cease immediately. If you wish to terminate your account, you may simply discontinue using the Platform or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Platform shall be instituted exclusively in the courts located in London, United Kingdom. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Platform.
